Islamabad High Court declares imposition of Super Tax as illegal

ISLAMABAD:Accepting the petitions filed by various companies, the Islamabad High Court (IHC), while pronouncing a reserved verdict on Thursday, declared the imposition of billions of rupees of Super Tax illegal. The court also declared all the notices issued for the recovery of the tax null and void. Similarly, it also declared section four C of the Income Tax Ordinance illegal. In a detailed judgment, Justice Sardar Ishaq Khan also explained the court’s objections to the section.

Salman Akram Raja and Adnan Haider Randhawa represented the petitioners in the case. Three weeks ago, the Lahore High Court (LHC), while deciding on multiple petitions filed against the imposition of the Super Tax, had affirmed legality of the tax. However, Justice Jawad Hassan of the LHC while giving the ruling reduced the tax rate from 10 percent to 4 percent for 16 sectors, including banking. Over 350 petitioners had challenged the imposition of the tax in 2022.

Representatives from the federal government and the Federal Board of Revenue (FBR) opposed the petitions. It is worth noting here that the federal government has recently announced the imposition of the super tax for the year 2023.
