ECP Empowered to Annul Poll Results Up to 60 Days After Official Declaration

Contrary to popular belief, the official publication of election results in the Gazette does not signify their finality, as Pakistan”s electoral law grants the Election Commission a powerful 60-day window to declare a poll void, providing a critical post-election accountability channel.

Under Section 9(3) of the Elections Act 2017, the Commission is authorised to nullify an election up to two months after a winning candidate”s name is officially published. This authority can be invoked if the ECP, following an inquiry, is convinced that grave illegalities or breaches of electoral regulations materially impacted the outcome across one or more polling stations or the entire constituency, according to a report today.

The legislation specifically addresses the disenfranchisement of female voters. The law empowers the ECP to annul a constituency”s poll if evidence suggests women were prevented from casting their ballots through an organised agreement. Furthermore, if female voter turnout drops below 10 per cent of the total votes cast, the Commission is directed to presume such an agreement existed and may void the result accordingly.

The ECP”s decision is not without recourse. Section 9(5) of the same Act stipulates that any person aggrieved by the Commission”s declaration has a 30-day period to appeal the decision directly to the Supreme Court.

This legal provision establishes a vital accountability mechanism that operates independently of the traditional Election Tribunal process. It is particularly relevant in situations where electoral irregularities are widespread but do not conform to the strict framework of an election petition.

For citizens, civil society, and election observers, this 60-day period is a crucial timeframe for compiling and submitting documented proof of serious violations to the electoral body. The existence of this legal instrument means its effective use hinges on credible evidence being presented to the ECP within the statutory deadline.
